Zoning Change Process
Apply for a Zoning Change
To apply for a property rezoning, the Rezoning Application must be completed, along with the required material.

Rezoning Procedure
- REZONING APPLICATIONS
- Items required at time of submittal:
- Zoning application
- Payment per fee schedule
- Legal description of property to be rezoned on a survey or deed
- Certified list of all property owners within a 300’ radius of property to be rezoned. The list shall be current and certified by a registered professional engineer, a registered land surveyor, an attorney, a bonded abstractor, or other person qualified to research county records as determined by the City Attorney.
- Map of area to be rezoned, no larger than 8.5”x11”
- If a representative is making the request to rezone on behalf of a property owner, a letter of authorization from the property owner(s) must be submitted indicating their desire to rezone and who is to represent them in this matter.
- Staff may ask for additional information.
- Once received, a date is set for a public hearing and discussion and consideration for a Planning Commission Meeting and the following City Council meeting. The first City Council meeting will be the first reading of the zoning ordinance. If approved, the Council will have a second reading of the zoning ordinance.
- City staff will construct a zoning ordinance that includes a copy of the map of the property to be rezoned. Once a public notice is put in the newspaper, place copy of the notice with the ordinance for filing.
- City staff will send a Public Hearing notice to the residents in a 300’ radius of property within 20 days of meeting.
- Protest Forms can be received from the community up to three calendar days before the meeting.
- City staff will have Public Hearing notice published in the newspaper 15 days before the meeting.
- City staff will post Public Hearing in City building window 15 days before the meeting.
- Planning Commission will review the application and submit their recommendation to the City Council.
- City staff will publish a Public Hearing in the newspaper 15 days before the City Council meeting.
- City Staff will post a Public Hearing notice in the window at the City building 15 days before the meeting.
- City Council will review the application and will vote to approve or deny.
- If approved, the ordinance will return to the City Council for a second reading of the ordinance.
- If passed with an emergency, the zoning ordinance goes into affect once the ordinance is published in the newspaper.
- If it passed without an emergency, the zoning ordinance will go into effect 30 days after the ordinance is published in the newspaper.
- City staff must revise City zoning maps and provide the change of zoning to the GIS firm for a full update.
- City Staff will place a copy of new zoning ordinance in the Approved Zoning Ordinances book in the Community Development department.
- City Staff will include the Public Hearing notice and the included map with all versions of the new ordinance for future clarity.
